Property Tax Grievance

If you own property in New York State, you are eligible for formal review of your assessment.

Before pursuing formal review of your assessment, Attorney John Giacobbe will determine if you are assessed fairly. If the Assessor’s estimate of the market value reflects the fair market value of your property, then your assessment is fair and a grievance is not right for you at this time. Attorney Giacobbe will:

Determining the Assessor’s estimate of the market value of your property.

  • (Assessment ÷ level of assessment = assessor’s estimate of market value.

Assist you obtaining and reviewing an estimate of the fair market value of your property.

  • A recent appraisal or purchase price.

If, however, your assessment is too high, Attorney Giacobbe can help you. The first level of review is called “Administrative Review,” which is conducted at the municipal level. Attorney Giacobbe’s Administrative Review Agreement provides for legal representation at the first level of the tax grievance assessment on a contingency fee basis whereby you are not charged a legal fee unless he is successful in obtaining a reduction on your behalf. Typically, this fee is 1/3 of the first year’s savings.

The second level of review is called “Judicial Review.” To reach this level, you must lose your Administrative Review. The Judicial Review process includes two options: (1) Small Claims Assessment Review (SCAR), and (2) Tax Certiorari proceedings in State Supreme Court. The Judicial Review process is not part of the Assessment Review Agreement and the legal fees vary. We do our best to avoid this level of review by making sure we accurately determine if you are assessed fairly before we accept your tax grievance.
